Terms and Conditions for North Breeze Adventures Charter Services

1. Introduction These Terms and Conditions govern the agreement between North Breeze Adventures (hereinafter referred to as "the Company") and the individual or entity booking the charter (hereinafter referred to as "the Client"). By booking a charter, the Client agrees to be bound by these terms.

2. Legal Framework These terms are governed by the laws of Malta. While the Constitution of Malta establishes the supreme legal framework of the country, specific commercial obligations are primarily governed by the Civil Code and relevant maritime or aviation laws of Malta.

3. Bookings and Payment

• Reservations: A booking is only confirmed once a deposit of10% is received.

• Final Payment: The remaining balance must be paid at least 2days prior to the scheduled charter date or as otherwise agreed with the company.

• Currency: All payments shall be made in Euro (€).

4. Cancellations and Refunds

• Client Cancellation: If the Client cancels 5 days before the charter, a full refund will be issued. Cancellations made after this period are non-refundable.

• Company Cancellation: The Company reserves the right to cancel or reschedule a charter due to adverse weather conditions or safety concerns. In such cases, a full refund or alternative date will be offered.

5. Conduct and Safety

• The Client and their guests must follow all safety instructions provided by the Captain/Crew.

• The Company reserves the right to terminate a charter without refund if the Client’s behavior is deemed illegal, dangerous, or a nuisance to others.

6. Liability

• The Company maintains standard insurance for its operations. However, the Company is not liable for the loss or damage of personal belongings brought on board by the Client.

• The Client is responsible for any damage caused to the vessel or equipment due to negligence or misconduct.

7. Privacy and Data Protection In accordance with Maltese data protection standards, the Company will only use the Client's personal information to process the booking and provide the requested services.

8. Jurisdiction Any disputes arising from this agreement shall be subject to the exclusive jurisdiction of the Courts of Malta.
